Question by Evie: Can I legally break my lease due to other tenant’s drug use?
I signed a one year lease less than a month ago (Missouri). I went with this place because it was a non-smoking property right next to the local police department.

After moving in, however, there is a heavy odor of marijuana in the stairwell and it even permeates my apartment (almost daily).

I have brought this issue to the attention of my landlord twice with no resolve. Since I am in the military, I’m concerned about being around this type of behavior.

Can I break my lease without financial loss? Any advice would be greatly appreciated.

No, you cannot break you lease for that. If you can find where it is coming from, you could complain to the landlord again.

    No. This is not a legal reason to break your lease.

    What you should do is call the police on your other tenant.

    You will need to make a police report of the problem. If the landlord will not get the problem under control then the owner could lose his property.
    And if it still is not taken care of you then have a right of unlawful activity on the property with the police to back you up you can get out of the lease.

    Call the Police, tell them you have informed the landlord. If the landlord is aware of illegal situation going on in the apartment and does nothing about it he is breaking the law.

    Not sure how you can prove he know but being you live next store to the PD it should be easy to talk to them.

    no, you can not break your lease this early…try asking them if you could transfer to another apt (in the same complex)..if they say no, I suggest buying an air purifier for your home.

    Criminal behavior on the property which jeopardizes you (and being in the military, especially, criminal drug possession or use on the property where you live jeopardizes your reputation and livelihood as well as your safety) can be grounds for terminating a lease if the owner fails to exercise due care and control of criminal behavior on the property. Tell your landlord to do something about the criminal behavior or you are out of there.

    No, you cannot break your lease over the odors of marijuana. HOWEVER, since you are right next to the local police department, you MIGHT inform someone there that you smell the aroma of burning marijuana. I’m guessing they might be pleased to investigate. The use of marijuana is not a landlord issue. It’s an issue for the authorities.

    they go in with bloodshot eyes raving and drooling , looking for something to kill . all that training and prep …. no confirmed kills ….too scared to join the service and face an enemy? that shoots back, and if they killed a child there would be too many questions ….most logical solution …..shoot the dogs …. the smell of gunpowder , the adrenaline rush of the kill , no questions asked …… why would one choose this occupation if not for some psycopathic thrill ?
